On August 31, 2022, BBB requested Amerisleep to modify, substantiate, or discontinue claims made on their website (http://www.amerisleep.com/) that read, "Fast shipping, free returns, 100 night trial", “See why our customers love their Amerisleep Mattress..Pain Relieving..”, Customer reviews state, "Best mattress for back pain!" & "The Best Bed For Someone with Three Back Surgeries", "100-night, risk-free mattress trial..Try our mattresses risk-free for 100 nights. If you aren’t completely satisfied, we’ll give you a full refund and help arrange a mattress removal…”, “..Love it or your money back..If you don’t love your Amerisleep mattress, contact us within 100 nights to begin a return. Note: We do require customers to sleep on their mattress for at least 30 nights in order to take full advantage of the Adjustment Period. This ensures you're fully adjusted to the mattress before you're eligible for a free return. If, however, you decide you need to process a return within the 30 days (before day 31), we'd charge a $99 early processing fee.”, “Our hassle-free promise”, and “FREE SHIPPING..and free, no-hassle returns…” Advertisers must be prepared to substantiate such claims per BBB's Code of Advertising.

BBB's Code of Advertising Section 20 states, Advertisers should only use “satisfaction guarantee,” “money back guarantee,” “free trial offer,” or similar representations in advertising if the seller or manufacturer refunds the full purchase price of the advertised product or service at the consumer's request. BBB's Code of Advertising Section 1 states, The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB. BBB's Code of Advertising Section 30 states,  In general, advertising which uses testimonials or endorsements is likely to mislead or confuse if: It contains representations or statements which would be misleading if made directly by the advertiser; While literally true, it creates deceptive implications. BBB's Code of Advertising Section 34 states, Claims relating to performance, energy savings, safety, efficacy or results for a product or service should be based on recent and competent testing or other objective data. Additionally, BBB's Code of Advertising Section 14 states, An advertiser may use the word “free” in advertising whenever the advertiser is offering an unconditional gift. If receipt of the “free” product or service is conditional on a purchase: Because the consumer continually searches for the best buy and regards the offer of “free” products or services to be a special bargain, all such offers must be made with extreme care so as to avoid any possibility that consumers will be misled or deceived. Representative language frequently used in such offers includes: “Free”, “Buy 1-Get-1 Free”, “2-for-1 Sale”, “50% off with Purchase of Two”, “$1 Sale”, “1/2 Off”, “Gift with Purchase” Literally, of course, the advertiser is not offering anything “free” (for example, an unconditional gift), or 1/2 free or 2 for 1 when making such an offer, since the consumer is required to purchase a product or service in order to receive the “free” or “2 for 1” item.
